Alfred Vargas and his wife Yasmine suffered a setback after the criminal complaint that they filed against Rob Sy and his wife over an alleged bullying of their child was junked by the Office of the City Prosecutor of Manila for lack of evidence.

The actor-politician and his wife had filed a case for violation Section 10(a) of Republic Act No. 7610, or the Special Protection of Children Against Abuse, Exploitation and Discrimination Act, alleging that Sy’s son bullied their son.

“The complainants argue in the main that the respondents’ purported failure to intervene and supervise their son is the cause of their child’s predicament. However, such argument appears to be merely based on speculation. Allegation is not in itself evidence,” a part of the decision dated May 12 read, as per the document shared by Sy on his Facebook page on Wednesday, May 27.

“Accordingly, the undersigned finds no prima facie evidence with reasonable certainty of conviction to indict respondents for violation of RA 7610,” it added.

In the caption, Sy underscored that the dismissal of the complaint against him and his wife Juvelle Bacosa vindicated their son and their family.

“Mula pa lamang sa simula, nanindigan kami na ang reklamong ito ay isang kalkuladong ‘Narrative Reversal’ at isang pagtatangkang baliktarin ang tunay na pangkalahatang kwento gamit ang media portrayals at emotional theatrics imbes na objective facts at totoong ebidensya,” he said. “Sa kabila ng online hostility, cyberbullying, at maagang paghusga ng ilan na aming tiniis sa buong ordeal na ito, pinili naming huwag sumabay sa pampublikong drama.”

(From the very beginning, we maintained that this complaint was a calculated ‘narrative reversal’ and an attempt to twist the real overall story using media portrayals and emotional theatrics instead of objective facts. Despite the online hostility, cyberbullying, and premature judgment from some people that we endured throughout this ordeal, we chose not to engage in the public drama.)

“Bagama’t nauunawaan namin sa paliwanag ng aming abogado na maaari pa itong i-apela o humaba pa sa legal na proseso, ang DISMISSAL o PAGBABASURA na ito ay isang mahalaga at kinakailangang vindication para sa aming pamilya, lalo na sa aming anak,” he added.

(Although we understand, based on our lawyer’s explanation, that this can still be appealed or may go through a longer legal process, this dismissal is an important and necessary vindication for our family, especially for our child.)

Sy also thanked those who have extended help to his family, especially their legal counsel, co-parents and the witnesses who shared testimonies with regard to the accusations made by the Vargas couple.

“Moving forward, ang ultimate goal namin ay tuluyang ma-‘fireproof’ ang aming anak mula sa epekto ng masakit na kabanatang ito. Ang absolute priority namin ay protektahan ang kanyang kapayapaan, emotional security, at overall well-being, at siguraduhing lalaki siyang ligtas, matatag, at protektado ng katotohanan,” he stated.

(Moving forward, our ultimate goal is to fully fireproof our child from the impact of this painful chapter. Our absolute priority is to protect his peace, emotional security, and overall well-being, and to ensure he grows up safe, strong, and protected by the truth.)

Alfred and Yasmine have yet to publicly comment on the matter as of this writing.

Aside from the child abuse complaint, the couple also lodged 20 counts of cyberlibel against Cy, citing the actor’s social media posts containing allegations against the Vargas family. /edv
